Lovekept is a place to remember the people we love with dignity. Because families, friends, and visitors create the memorial pages, obituaries, guestbook entries, and photos you see, we ask everyone to use the Service in a way that keeps it safe and respectful. This Acceptable Use Policy explains what is and is not allowed on Lovekept. It supplements, and forms part of, our Terms of Service, and any violation is handled under those Terms.
1. Who and What This Covers
This policy applies to everyone who uses Lovekept, including account holders who create memorials, collaborators invited to help build them, and visitors who leave a guestbook entry, a photo, a comment, or a reaction without an account. It applies to every piece of content you add anywhere on the Service, including memorial titles and descriptions, fundraiser titles and stories, obituaries and life stories, timeline entries, events and services, guestbook messages, photo captions and comments, and the names and images you upload. Throughout this policy, "content" means all of these.
2. The Spirit of a Memorial
A Lovekept memorial exists to honor a life and to give the people who loved that person a shared place to grieve, remember, and support one another. Everything you post should fit that purpose. We know a real life can be complicated and may touch on difficult subjects, and honest remembrance has room for that. What we do not allow is content that turns a memorial into something it was never meant to be: a place to attack people, to sell things, to collect money off-platform, or to store unrelated files.
Obituaries, life stories, and other biographical content must be respectful and factual. A memorial is not a place to settle scores. Even where a life carried genuine hardship or conflict, content written to disparage, mock, demean, or shame the person being memorialized is not allowed, and we may edit or remove it. Honest remembrance can acknowledge that a person was complicated without turning their memorial into an attack on them.
Use good judgment. If you would not say or show it to a grieving family standing beside you, it does not belong on a memorial.
3. Content That Is Not Allowed
You may not post, upload, or share content that is or that contains any of the following:
- Illegal content: Anything that violates any applicable law, or that promotes, facilitates, or references illegal activity, including the sale or use of illegal drugs.
- Hateful or discriminatory content: Hate speech, slurs, or content that attacks or demeans people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.
- Harassment, threats, and bullying: Content that harasses, intimidates, threatens, or bullies the deceased, their family, other users, Lovekept staff, or anyone else, including doxxing or the posting of private information to expose or endanger a person.
- Defamation: False statements of fact that damage the reputation of the deceased, their family, or any other person. Raising sensitive details about the deceased with malicious intent to shame, degrade, or distress surviving family members is not allowed.
- Sexual or graphic content: Nudity or sexually explicit material, and gratuitous violence, gore, or shocking imagery that is not appropriate for grieving families.
- Graphic imagery of death or injury: Explicit depictions of a body, wounds, or the scene of a death. Peaceful funeral or visitation photographs, including open-casket photographs, are allowed at the memorial owner's discretion.
- Deceptive synthetic media: AI-generated or digitally manipulated images, audio, or video that presents the deceased saying or doing things they did not, or that is passed off as a genuine record. Disclosed restoration, colorization, or repair of real photographs is fine.
- Promotion of self-harm: Content that encourages, instructs in, or glorifies suicide or self-harm. Honestly acknowledging that a death was by suicide or overdose is welcome and is never a violation.
- Impersonation and fake memorials: Memorials for a living person, for a fictional or invented person, or created by someone with no genuine connection to the deceased and no authority to memorialize them, as well as any attempt to impersonate another person or organization.
- Privacy violations: Personal or sensitive information about a living person shared without their permission, or content that intrudes on someone's privacy.
- Malware, phishing, and harmful links: Links or files intended to deceive, defraud, distribute malware, or harvest personal or financial information.
- Spam and junk: Repetitive, automated, gibberish, or clearly fake or test content that has no place on a memorial.
4. Fundraising and Requests for Money
We understand that a death often brings real financial need, and that families frequently want a way to accept help. To keep memorials safe from fraud and to protect grieving visitors, we place clear limits on how money may be requested on Lovekept. You may not use a memorial, a guestbook entry, a photo, a caption, a comment, or any other content to route or collect money outside Lovekept through off-platform payment links, handles, accounts, codes, or similar means. In particular, the following are not allowed:
- External fundraiser or donation links: Links to off-platform fundraising or donation pages, for example GoFundMe, GiveSendGo, Fundly, a Facebook fundraiser, or any other third-party campaign or "donate" page.
- Personal payment handles or accounts: Requests to send money through personal payment services or handles, for example PayPal, Venmo, Cash App, Zelle, Apple Pay, or Google Pay, or the posting of any account name, username, or number used to receive money.
- Payment or donation QR codes: Photos or images whose purpose is to display a QR code, barcode, or other scannable code that directs people to pay, donate, or move to an off-platform payment destination.
- Cryptocurrency solicitation: Wallet addresses or requests for payment in cryptocurrency of any kind.
We put these limits in place because Lovekept cannot verify where an off-platform link or payment code actually sends money, and grieving audiences are a common target for scams. Removing that channel protects the families and communities who gather on a memorial.
If you need to raise funds in someone's honor or memory, use a built-in Lovekept fundraiser, which keeps the appeal on Lovekept, on its own fundraiser page and on the memorial when there is one, is processed securely through our payment provider, and is governed by our Fundraising Terms. This is the only sanctioned way to collect contributions on Lovekept. None of the above prohibits a sincere message that mentions a fundraiser or invites people to give in someone's memory, as long as it contains no external link, payment handle, account detail, wallet address, or payment QR code.
5. Advertising and Commercial Use
A memorial is not an advertising space. Without our prior written permission, you may not use the Service to:
- Advertise, promote, or sell any product, service, or business;
- Post affiliate links, referral links, coupon codes, or other promotional links;
- Solicit customers, followers, subscribers, or leads for any venture; or
- Publish content for the purpose of search engine optimization, link building, or other promotion unrelated to the memorial.
Sincere mention of a business connected to remembrance, such as a funeral home handling arrangements or a charity the family has asked people to support, is fine when it is genuinely informational and does not include promotional links or payment solicitation covered by Section 4.
6. Authenticity and Connection
When you create a memorial, you represent that you personally knew the deceased or hold valid authority to act on their behalf, and that the information you provide about them is truthful. You must own or have secured every right, license, and permission needed for the content you upload, and your content must not infringe the intellectual property, privacy, or other rights of any third party. Do not create a memorial for a living person, for an invented person, or in a way designed to mislead about who the person was or who is memorializing them.
7. Platform Integrity and Security
To keep the Service reliable and secure for everyone, you agree not to:
- Interfere with, disrupt, overburden, or impair the Service or the servers and networks that support it;
- Attempt to gain unauthorized access to any part of the Service, to another user's account, or to any connected system;
- Exploit any bug, vulnerability, or security weakness in the Service;
- Access, monitor, copy, or scrape content through any robot, spider, scraper, or other automated means, or work around any measure we use to limit access, without our express written permission;
- Treat a memorial as general file storage, a data repository, or a content delivery network for files unrelated to remembering the deceased; or
- Enter a mobile number that is not yours, or that you are not authorized to use, to receive Lovekept text messages, or use our text messages to harass, mislead, or contact anyone who has not agreed to hear from us.
8. How We Enforce This Policy
We use a combination of automated systems, human review, and reports from our community to keep memorials safe. Many contributions to a memorial pass through automated review, which can reject content that appears to break this policy, such as off-platform donation links and payment QR code images, before it is published. Some contributions, such as photos a guest adds to a memorial's timeline, are also held for the memorial owner to review before they appear. No automated system is perfect, so we also rely on reports and act on content after the fact when needed. If you believe we removed your content or rejected a submission in error, email support@lovekept.co with a link and we will take another look.
As described in our Terms of Service, Lovekept may, at its sole and absolute discretion, review, refuse, edit, hide, remove, or unpublish any content or memorial at any time, with or without a reason and without prior notice. Depending on the nature and severity of a violation, we may also:
- Contact the account holder responsible for the content;
- Restrict, suspend, or permanently terminate an account; and
- Take any other action available to us, including reporting unlawful activity to the appropriate authorities.
9. Reporting a Violation
If you see content that breaks this policy, please tell us. Our Report Content page explains how to flag abusive or inappropriate content, request removal as a family member, and submit a copyright (DMCA) notice. You can report content whether or not you hold a Lovekept account. You can also email us directly at support@lovekept.co.
10. Relationship to Our Terms
This Acceptable Use Policy is part of, and incorporated into, our Terms of Service, and it works alongside our Privacy Policy and, for fundraising features, our Fundraising Terms. A breach of this policy is a breach of the Terms of Service and may lead to removal of content or termination of your account under Section 3 (User Conduct and Content) and Section 12 (Termination) of those Terms. If anything in this policy appears to conflict with the Terms of Service, the Terms of Service govern.
11. Changes to This Policy
We may update this policy from time to time as the Service evolves or as new kinds of misuse emerge. When we make a material change, we will update the date at the top of this page and, where the change is significant, provide notice as our Terms of Service describe. Continuing to use the Service after a change takes effect means you accept the updated policy.
